Who received the ticket? Will you hear the answer in court?
Did you know who received the “ticket” is not admissible in a Florida jury trial for negligence? The rationale is a jury will give unfair weight to the police officer’s determination of fault in an accident. It really makes sense if you think about it. A jury is supposed to be the fact finder, but what would a juror say to another juror? Of course fault is on the side of the person who got the ticket. The police officer was there and talked to everyone. As a juror you’d be hard pressed to disagree. So know you know; if you’re fortunate to serve on a jury you will not hear from the investigating officer who received the “ticket” As a juror that’s your call!
